These Terms of Service ("Terms") govern your access to and use of The Artful Recipe Club, operated by THE ARTFUL SCAVENGER, LLC. By creating an account, subscribing, or making a purchase, you agree to these Terms. Please read them carefully.
1. Eligibility and Accounts
You must be at least 18 years old to create an account or make a purchase. You are responsible for keeping your login credentials confidential and for all activity under your account. Please notify us immediately of any unauthorized use.
2. Membership and Billing
Memberships are offered on a monthly plan at $7.99 per month and an annual plan at $79.99 per year. New memberships begin with a 30-day free trial. You will not be charged during the trial period.
Automatic Renewal
In plain language: when your free trial ends, your membership automatically begins and your payment method is charged the plan price. Your membership then renews automatically at the end of each billing period (monthly or annually) at the then-current price, until you cancel. We will send a reminder before your trial ends and before any annual renewal.
How to Cancel
You can cancel at any time from the account page or by emailing info@artfestivalthornebrook.com. When you cancel, you keep access until the end of your current billing period, and you will not be charged again. Cancelling does not retroactively refund a period already started, except as provided in our Refund Policy.
3. Purchases from the Kitchen Shop
Prices for physical products are shown in U.S. dollars and may change. We strive for accuracy but reserve the right to correct errors and to cancel orders affected by an obvious pricing mistake. Shipping and returns are governed by our Refund Policy.
4. Acceptable Use
You agree not to copy, redistribute, scrape, or resell our recipes, content, or images; not to share your account credentials; and not to use the Service in any way that is unlawful, infringes the rights of others, or interferes with the operation of the Service.
5. Intellectual Property
All recipes, text, branding, and original content on the Service are owned by THE ARTFUL SCAVENGER, LLC or its licensors and are protected by intellectual-property laws. Photographs are provided under license from their respective creators. Your membership grants you a personal, non-transferable license to access content for your own household use; it does not transfer ownership of any content to you.
6. Disclaimers
The Service is provided "as is" and "as available." Nutritional information is approximate and provided for general guidance only; it is not medical or dietary advice. You are responsible for following safe food-handling practices and for any allergies or dietary restrictions in your household.
7. Limitation of Liability
To the fullest extent permitted by law, THE ARTFUL SCAVENGER, LLC and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose.
8. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Subject to the arbitration provision below, any dispute will be brought in the state or federal courts located in Florida.
9. Arbitration and Class Action Waiver
Except for small-claims matters, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, rather than in court. You and we each waive any right to a jury trial and to participate in a class, collective, or representative action. Arbitration will take place in Florida unless you and we agree otherwise. You may opt out of this arbitration provision by emailing us within 30 days of first accepting these Terms.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted here with an updated date, and your continued use of the Service after changes take effect constitutes acceptance.
